The History of Cannabis

Let’s talk a little about the history of cannabis. Politicians in the United States have used cannabis as a tool of division throughout much of the twentieth century. Cannabis and the legislation that attempted to regulate it fueled some of America’s worst prejudices regarding race, ethnicity, and otherness by being used as a scourge from the the border to a corrupting intoxicant of choice for beatniks and hippies.

Cannabis was initially characterized by the federal government as a criminal menace that had to be combated, with accounts of cannabis use originating in Mexico and flowing across the border. The government labeled cannabis a narcotic for inner-city areas and minorities, while also misleading the public about it, resulting in murder, rape, and insanity. Following this, political opponents of Richard Nixon and Ronald Reagan developed and implemented legislation to target a number of areas across the country.

Communities of color have long been the focal point for America’s cannabis policies. Despite comparable use rates among whites and non-whites, Black Americans are arrested for cannabis offenses at a rate of nearly 4:1, compared to whites. These laws also affect a large number of Americans in a country where over 700,000 cannabis-related arrests are made each year (a figure that was above 800,000 several years ago).

Over the previous several years, officials have passed cannabis prohibition and decriminalization measures in an effort to curb these arrest totals. Arrests have decreased substantially in states that have legalized; however, racial disparities in arrests have remained largely unaffected. Legalization or decriminalization are steps in the correct direction, but they only help to solve the problem now and in the future. The majority of those changes do little to remedy the past.

In an effort to repair the drug war’s mistakes, some states have used record expungement for minor cannabis offenses in order to compensate for those wrongs, according to a recent study. The impact of the Drug War, on the other hand, is more long-lasting and ingrained than record expungement will correct.

However, the future of cannabis legislation in the United States must include expungement (ideally, automatically), as well as more comprehensive measures to assist communities that have been devastated by the War on Drugs. Even after cannabis is legalized, prior arrests cannot be undone, and record expungement does not compensate for the decades of missed educational, occupational, and other related possibilities as a result of that drug arrest. Nor does record expungement support those whose lives have been harmed as a result of a family member’s drug arrest or imprisonment.

There are several ways that state legislation may assist those who were most severely affected by the War on Drugs. The first step is to retrain police in ways that address present and ongoing racial disparities following legalization. Police departments might use the adjustments made to cannabis laws to improve some of the behaviors, decisions, and biases that contribute to unacceptable race gaps in arrest rates.

To provide new and long-term ownership possibilities for people of color and those with prior, low-level cannabis convictions, more effective policies must be put in place to legalize states. Several states have attempted to develop such plans, but they have generally fallen short of expectations.

For decades, the American justice system has taken money and opportunity from individuals. Racism was institutionalized and enforced in specific communities throughout history, and now that cannabis is legal in some states, it’s up to legalization to institute the means for their rehabilitation.
